Welcome! These Terms of Use ("Terms") govern your access to and use of rate-my-photo.com and its free AI photo rating tool (together, the "Service"). The Service is operated by rate-my-photo.com ("Rate My Photo", "we", "us" or "our").

By accessing or using the Service, you agree to be bound by these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.

1. Who may use the Service

You must be at least 13 years old to use the Service, or at least 16 years old in regions where that higher minimum age is legally required. By using the Service, you confirm that you meet the minimum age that applies where you live.

2. The Service

The Service uses automated image analysis (AI) to rate the aesthetic and technical quality of a photo on a scale from 1 to 10. It is free to use and does not require an account. We may change, suspend or discontinue all or part of the Service at any time.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes.

3. Your photos

Your photos remain yours. These Terms do not give us any ownership rights in the photos you upload.

How we handle your photos: Your photo is processed in memory on our servers only to calculate your rating. It is not saved afterwards, not shared with third parties, and not used to train or improve our software. Our Privacy Policy explains this in more detail.

The permission you give us: When you upload a photo, you give us a limited, non-exclusive, royalty-free permission to process that photo solely to calculate your rating and show you the result. This permission ends automatically once your result has been delivered. It does not allow us to publish, distribute, sell or sublicense your photo, or to use it for any other purpose, including training or improving our software.

What you may upload: You may only upload photos that you took yourself or that you have the right to use. If a photo shows other people, you must have their permission to upload it. You must not upload photos of anyone below the minimum age applicable to use the Service. You also must not upload:

  • photos you do not have the right to use, or photos that infringe anyone's copyright, privacy or personality rights;
  • sexually explicit, violent, hateful or otherwise illegal content.

You are responsible for the photos you upload.

4. Acceptable use

You agree not to misuse the Service. In particular, you agree not to:

  • use the Service to harass, shame or rank other people, or to rate photos of people without their consent;
  • use ratings to make decisions about other people's employment, housing, credit, insurance or similar opportunities;
  • attempt to probe, scan or test the vulnerability of any system or network, or breach any security or authentication measures;
  • access, tamper with or use non-public areas of the Service, our computer systems or the technical delivery systems of our providers;
  • interfere with or disrupt (or attempt to interfere with or disrupt) the access of any user, host or network, for example by sending a virus or by overloading, flooding or spamming the Service;
  • use automated systems (such as bots or scrapers) to access the Service, or send more requests than a person can reasonably produce with a normal web browser;
  • sell or resell the Service or access to it;
  • reverse-engineer, decompile or disassemble the Service, or attempt to extract its AI models, except where the law expressly allows this;
  • violate any applicable law or regulation.

5. About the ratings

Ratings are produced automatically by an AI model. They are estimates of a photo's aesthetic and technical quality, based on patterns the model learned from its training data, and are provided for information and entertainment only. Ratings may be inaccurate. A rating is not a statement about the value or worth of any person.

6. Our intellectual property

The Service and its original content (excluding your photos), features and functionality are and will remain the exclusive property of rate-my-photo.com and its licensors. They are protected by copyright, trademark and other laws. You may not use our name, trademarks (including "Rate My Photo" and "rate-my-photo.com"), logos or trade dress in connection with any product or service without our prior written consent.

We welcome feedback, comments and suggestions for improving the Service ("Feedback"). If you send us Feedback, you agree that we may use it freely, without any obligation or payment to you.

7. Third-party links and services

The Service may contain links to third-party websites, apps or services, including app store pages, that we do not own or control. We have no control over, and assume no responsibility for, their content, privacy policies or practices. We are not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by your use of, or reliance on, any content, goods or services available on or through them. We strongly advise you to read the terms and privacy policies of any third-party websites or services that you visit.

8. Suspension and termination

You are free to stop using the Service at any time. We may suspend or block your access to the Service, at our sole discretion and without notice, if you breach these Terms or if you use the Service in a way that causes or may cause us legal liability, or that disrupts the Service or other people's use of it.

Provisions that by their nature should survive termination will survive it, including, without limitation, ownership provisions, warranty disclaimers and limitations of liability.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT RATINGS WILL BE ACCURATE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR (B) ANY LOSS OF USE, DATA, BUSINESS OR PROFITS, REGARDLESS OF LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN WARNED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE THE SERVICE IS FREE, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED USD 20.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence, or for death or personal injury caused by negligence.

11. Governing law

These Terms are governed by the laws of the country in which the operator of rate-my-photo.com is established, without regard to its conflict-of-law rules. If you use the Service as a consumer, this choice of law does not deprive you of the protection of the mandatory laws of your country of residence, and you may also bring claims in the courts of that country.

12. Changes to these Terms

We may revise these Terms from time to time. The current version will always be posted on this page, with the "Last updated" date at the top. If a change is material, we will also show a notice on the Website. By continuing to use the Service after the changes take effect, you agree to the revised Terms. If you do not agree to them, please stop using the Service.
